All you need to know about new building norms in Kerala

Under the latest Kerala building norms in 2024, strict norms have been bought under building activities. These changes will ensure that safety and safer urban planning measures are followed in Kerala.

As per Kerala Building rules of March 12, 2024- The unauthorised buildings built prior to 7th November 2017 will be regularised by paying a fee ranging between Rs 1000 to Rs 10,000 based on the purpose and type of building.

These new rules have been only released for buildings under Panchayat. Even if the building is partially unauthorised, the owner will have to pay a fee amount for the whole construction.

The property owners will also have to pay a regularised fee if in case the building is not properly located at a specified distance from the road. The amount will be calculated based on the land value.

Kerala Building Rule 2024

To support safe, secure, and efficient growth, Kerala's rapid urbanization and development have made strong regulations necessary. The Kerala Building Rules has been revised in 2024, which represents a crucial step towards the state's approach to urban planning and construction.

Through integrating growth with environmental and social considerations, these policies intend to cater to the evolving needs of Kerala's towns and cities. Therefore, every individual must understand these building laws, their aim, and their aspects. This is to provide the safe construction of buildings in India.

The Kerala municipality building rules were recently replaced by a new set of rules enacted by the state government. They are listed below:

  • The construction cannot start with a building permit.

  • According to the rule, 30 square meters of land must be available.

  • The new rule mandates a 3-meter distance between the front of the building and the road.

  • Building a plinth area of up to 100 square meters will lead to Rs 2 lakh fine.

  • The building permissible line refers to the line that runs parallel to the plotter's frontline at a minimum distance of the yard's width. Additional lines are being fixed by the authority.

  • For individual properties in the city, plan approval is mandatory. You have to maintain open space in the front, back, and side of the construction with maximum ground coverage.

  • You have to choose a good neighbourhood free from conflicts and disruptive behaviour.

  • The building rules will consider the usual void distances between the buildings. This is to construct the smaller buildings.

The parking space provided to park cars should not be less than 15 sq. mts. area (5.5 mts. x 2.7mts), and for scooters and cycles the parking space should not be less than 3 sq. mts. and 1.5 sq. mt. respectively.

Building regulations ensure the protection of buildings from fires, earthquakes, and structural problems. The Kerala Building rules limit a way to new stricture.   • Municipal Building Rules in Kerala
  • Panchayat Building Rules in Kerala

These two are essentially equal.

Property in the Municipality area with more than 3 cents:

  • In front, back, and side of the house, there must be a minimum of 3 meters of distance between the road and the house.
  • You can choose an average space in front and back of the construction.
  • You need the owner's permission to build a house on someone's land.

Property in the Municipality area with less than 3 cents:

  • The minimum distance is 2 meters in the front, 1 meter in the back, and 1.9 meters on the sides.
  • Neighbours must give permission.
  • You can build the house on the remaining 75 centimetres if you do not receive permission. However, there is no doorway below the lintel level.

Property in panchayat area with more than 3 cents:

  • You can build a house near someone else’s property with the permission of the owner.
  • If you don’t get permission, you can leave 75 centimetres and build a house. But there is no doorway below Lindtel's level.

Property in Panchayat areas with below 3 cents:

  • You cannot use the average options for shapeless panchayat plots with an area below 3 cents.
  • You can leave 2 meters in front, 1 meter in back, and 1 & 90 cm on each side.
  • The septic tanks and well should have a 7.5-meter radius between them.
  • All the houses must have a rainwater storage system.

Additional payments for Extra FSI (Floor Space Index)

In March 2023, The state government increased the additional fee prescribed for the higher Floor Space Index (FSI) in the master plan.

According to the master plan, an additional fee of Rs 10,000 per square meter is charged for an FSI more than the prescribed value mentioned in the regulation book of the master plan. This condition is applicable for the existing constructions or the constructions which had taken permission before the rollout of the master plan.

For an additional FSI, a payment of Rs. 10,000 per square meter is to be levied at a later stage.

These regulations aim to guide Kerala's development progressively while also taking into account the state's specific environmental and social context. It offers instructions for all types of constructions.
