Major benefits of the RERA Act:

Below are some of the major benefits of having RERA approval in your building:

  • Reduces the Risk of Builder Insolvency/ Bankruptcy.

  • Right of the Buyer in case of False promises.

  • Right of the Buyer in case of Defect after possession.

  • Rights of the Buyer Delay in possession.

  • Rights of the Buyer in case of defect in Title.

  • Right to information.

What Is The Penalty For Not Following Statutory Approvals:

  • Halt in Construction: Strict compliance with statutory permissions is critical for construction projects. Local governments have the power to instantly cease any building work that does not comply with approved plans and permits. This prompt intervention protects public safety and ensures compliance with building codes. The stoppage might occur at any point of the construction process, possibly causing major delays and requiring developers to address non-compliance issues before resuming work.

  • Demolition Orders: Authorities have the authority to issue Demolition Orders, which necessitates the entire or partial removal of prohibited structures. This serves as a powerful deterrent against flagrant violations and ensures public safety. However, demolition is rarely conducted lightly and is usually saved for extreme circumstances in which the unauthorized building poses a major threat to public safety or clearly breaches important building codes. Issuing such an order follows due process, considering the severity of the violation and attempts to achieve compliance through other means. This emphasizes the need of acquiring the necessary permits before construction begins in order to avoid such a drastic consequence.
